Terms and Conditions and Rules

  1. This private raffle is operated under the Gambling Act 2005 and is promoted by Capen Ltd, company registration no. 08141955

  2. By entering the draw, participants agree to be bound by these Terms & Conditions and Rules.

  3. The draw closes for entries at 12pm on Thursday 11th May.

  4. To enter the draw a ticket (or tickets) must be purchased by debit/credit card from an iPad as instructed by the promoter.

  5. The winner(s) of the draw will be chosen at random from all entries received by the closing date and time, and will be notified immediately by email.

  6. The winner will receive a bottle of champagne plus 50% of the ticket proceeds. The winner must be able to collect the champagne from Hinckley Island Hotel, Hinckley, Leicestershire, LE10 3JA on Thursday 11th May, prior to the close of the Lotteries Council Annual Conference.

  7. The winner will nominate a charity or good cause to receive the remaining 50% of proceeds.

  8. Your chances of winning are variable, depending on how many tickets are sold for the raffle as a whole. Your winning odds are the number of tickets you have purchased divided by the total number of tickets in the draw.

  9. The game is open to all Lottery Council attendees who are 18 (eighteen) or over on the date of ticket purchase, (except for employees of Capen).

  10. Any person found to be under 18 (eighteen) years of age on the date of ticket purchase automatically forfeits the right to the prize.

  11. When you purchase a ticket for the draw a unique ticket number will be issued and displayed onscreen at the point of purchase. Confirmation of your ticket number/s will also be emailed to the address supplied during the ticket purchasing process.

  12. Tickets to enter the draw are priced at £1 each and individuals are limited to a total spend of £100.

  13. All ticket sales are final. Refunds are at the sole discretion of the Promoter and will be payable only where the Promoter deems it reasonable, having regard for all the circumstances. All participants acknowledge that their payment of the ticket price does not guarantee that they will win any prize.

  14. Full payment for each ticket must be received in cleared funds before the ticket can be entered into the draw. Only tickets for which full payment has been received are eligible to win the prize/s.

  15. The Promoter shall not be liable to any participant for any loss or damage suffered or arising from:

    1. any delays or failures in the delivery methods used by the Promoter or the participant;

    2. any delays or failures in any software or other systems used by the Promoter for the administration of the draw;

    3. any delays or failures in the banking system used by the Promoter or the participant;

    4. any refusal by the Promoter to accept an individual’s entry or the cancellation of an entry;

    5. any event beyond the reasonable control of the Promoter.

  16. To the extent permitted by law, the Promoter excludes any liability for loss or damage incurred by any winner of a prize in connection with or arising from the use of the prize or participation in the draw.

  17. The Promoter is committed to protecting the privacy of participants. Personal information that is collected from participants is used lawfully in accordance with the Data Protection Act 1998. In providing your information to the Promoter, you consent to the Promoter using your information to process your entry and otherwise as described in these terms and conditions including (but not limited to) passing winners’ contact details on to representatives of third party companies used for the purposes of fulfilling the prize.

  18. The Promoter reserves the right to:

    1. disqualify or decline to accept the entry of any participant if it has reasonable grounds to believe the participant has breached any of these terms or otherwise acted fraudulently;

    2. terminate or suspend the draw for reasons beyond its reasonable control

  19. In the event of any dispute regarding the draw/s, if the dispute cannot be resolved by the parties, it will be referred to an independent third party.

  21. The Laws of England and Wales shall govern the interpretation and/or enforcement of these Rules. The Promoter and all participants hereby submit to the exclusive jurisdiction of the English courts.
